1031 Exchange Deadlines for North Scottsdale Luxury Sellers: The Year-End Calendar

Key takeaways

  • A 1031 exchange applies to real property held for investment or business use. Your primary residence does not qualify; it falls under a different rule (Section 121).
  • A second home can qualify only if it meets the IRS safe-harbor tests for rental and personal use, so check that before you list.
  • You have 45 days from the sale closing to identify replacement property in writing, and 180 days to close on it, or your return's due date if that comes first.
  • A sale that closes in mid-November 2026 reaches day 45 in late December, right when title, lenders and sellers slow down for the holidays.
  • The qualified intermediary must be engaged before the relinquished property closes. Touching the sale proceeds can end the exchange.

Who should be reading about a 1031 exchange this time of year?

Most of my North Scottsdale clients who ask about 1031 exchanges in November fall into three groups. Some own a long-held rental or a former vacation home in DC Ranch, Troon or Grayhawk and want to trade into a property with less management. Some are consolidating several smaller rentals into one larger property. Others own land or a casita property and want to move that equity into a different market or a different kind of real estate.

What they share is a calendar problem. A fall listing that goes under contract in October or November closes in November or December, and that starts two federal deadlines running straight through the holidays. In more than 30 years in this market, I've learned that the people who do well with an exchange plan the replacement search before the sale, not after it.

I'm not a CPA or a tax attorney, and nothing here is tax advice. My job is to make sure the real estate timeline, the contract and the market reality match what your CPA and qualified intermediary need.

Can I use a 1031 exchange on my North Scottsdale home?

Only if it is not your primary residence. A home you live in as your main residence is generally handled under Section 121, which can exclude a portion of the gain on a sale (up to $250,000 for a single filer or $500,000 for married couples filing jointly, if you meet the ownership and use tests). That is a separate rule with separate tests.

Second homes are the gray area. The IRS has a safe harbor (Revenue Procedure 2008-16) for a dwelling unit that is mostly rented rather than used personally. In broad terms, the property should be owned for at least 24 months before the exchange, and in each of the two 12-month periods before it, rented at a fair rental for at least 14 days, with personal use kept to the greater of 14 days or 10% of the days rented. A winter home you use from November through April and never rent usually won't fit. Ask that question before you sign a listing agreement, because it changes your whole plan.

How do the 45-day and 180-day deadlines work at year-end?

The clock starts the day your relinquished property closes. From that date:

  • Day 45: you must identify replacement property in writing, delivered to the proper party (usually your qualified intermediary).
  • Day 180: you must close on the replacement property, unless your tax return for the year of the sale is due sooner. If it is, the earlier date controls unless you file an extension.

Weekends and holidays do not extend either deadline.

Here is how that plays out with real dates this season:

  • Sale closes Friday, November 13, 2026: day 45 is Monday, December 28, 2026, and day 180 is May 12, 2027. The 180-day date falls after the usual April 15 return due date, so the full window depends on extending your 2026 return.
  • Sale closes Monday, November 30, 2026: day 45 is January 14, 2027, and day 180 is May 29, 2027. Without an extension of your 2026 return, the exchange window would end at the April 15 due date instead.
  • Sale closes Thursday, December 31, 2026: day 45 is February 14, 2027, and day 180 is June 29, 2027, again only if your return is extended.

I put those dates on a one-page calendar for every exchange client so the CPA, intermediary, lender and title company are all working from the same plan.

Why is the 45-day identification window the real pressure point?

Because the identification deadline lands in the slowest weeks of the year. If your sale closes in mid-November, day 45 falls in late December. That is when many owners pull homes off the market for the holidays, showings are harder to schedule, and some out-of-state sellers don't return calls until January.

The identification rules give you some room. Most investors use the three-property rule, which lets you identify up to three properties of any value. There are also a 200% rule and a 95% rule for larger portfolios. In practice, I recommend identifying a first choice and at least one realistic backup, each one already toured and with HOA documents requested, before day 45.

What should be in place before my sale closes?

  • A qualified intermediary engaged, with exchange documents signed and assigned into the escrow before closing. If the sale proceeds are paid to you, even briefly, the exchange can fail.
  • A replacement-property search under way, with criteria agreed: price band, product type, rental rules and location.
  • A conversation with your lender if the replacement will be financed. Replacing the debt you paid off, or adding cash, is part of avoiding taxable "boot".
  • A CPA plan for the extension, if the 180th day falls after your return due date.
  • Title and escrow told early that this is an exchange, so their documents and wiring instructions match.

Does a year-end exchange affect how I list and price my home?

It can. An exchange seller has two goals: a clean, on-time closing, and enough time on the back end to buy well. That sometimes means accepting a slightly longer close of escrow, negotiating a rent-back, or choosing the stronger-financed offer over the highest number.

It also means pricing to the market you are actually selling into. Scottsdale's Cromford® Market Index was 133.6 on October 29, 2026, still seller-leaning but cooling, while the Valley sat at 66.7 on October 31, 2026, a buyer's market. A home that sits because it was priced for spring pushes your whole exchange calendar into a less favorable season. For a deeper look at pricing levers, see my comparison of a price cut versus a rate buydown.

What about buying the replacement first?

Sometimes the right replacement property comes up before your current property sells. A reverse exchange can work in that case, using an exchange accommodation titleholder to hold one of the properties while the other closes, generally within 180 days. Reverse exchanges cost more and take more coordination, so start the conversation with your intermediary weeks ahead, not days.

Where should the replacement property be?

The replacement must also be real property held for investment or business use, but it does not have to be in Scottsdale or even in Arizona. Some clients exchange out of a North Scottsdale rental into property elsewhere. Others exchange into the Northeast Valley from out of state because they plan to retire here later. If you're considering a property you might eventually live in, ask your CPA how the rental-use period and later conversion rules apply before you buy.

For broader context on holding real estate here, my notes on North Scottsdale luxury real estate as an investment and Arizona property taxes on luxury homes are a useful starting point.

FAQ

What is the 1031 exchange deadline if I sell in December 2026?

You have 45 days from closing to identify replacement property and 180 days to close on it, but the 180-day period ends sooner if your 2026 tax return is due first. For most December sellers, that means filing an extension to keep the full 180 days. Confirm your dates with your CPA and qualified intermediary.

Can I do a 1031 exchange on my primary residence in Scottsdale?

Generally no. A primary residence is usually handled under Section 121, which has its own exclusion and tests. A 1031 exchange is for real property held for investment or business use.

Does a second home in North Scottsdale qualify for a 1031 exchange?

It can, if it meets the IRS safe-harbor tests for ownership period, fair-rental days and limited personal use. A winter home used mostly by the owner often does not qualify. Ask your CPA before you list.

Do I need a qualified intermediary before I list?

You need one engaged before the sale closes, and it is wise to choose one while you are listing. If you receive the sale proceeds, the exchange can fail.
